The discussion on the bill is expected to be quite a heated one. The Congress and the other opposition parties have been opposing it. They are saying that it will be a disservice to Muslim women.
The Muslim Women (Protection of Rights on Marriage) 2018 seeks to replace an ordinance issued earlier for protecting the rights of married Muslim women and prohibiting divorce pronouncing ‘talaq’ their husbands.
The bill will make the practice of instant triple talaq among Muslim men a penal offence. The fresh bill was introduced Lok Sabha on December 17th. It will replace an ordinance issued in September.
BJP leader Vijay Goel said that the government is committed to passing the bill. He added that it will benefit millions of Muslim women. Under the proposed law, giving instant triple talaq will be illegal and void. It will also attract a jail term of 3 years for the husband.
The fresh bill will supersede an earlier bill passed in the Lok Sabha. The previous bill is still pending in the Rajya Sabha. The earlier bill was approved the lower house.
Amid opposition some parties in the upper house, the government had cleared some amendments. This included the introduction of a provision of bail. This was in order to make the bill more acceptable. However, the bill continued to face resistance in the Rajya Sabha. The government then issued an ordinance in September, incorporating the amendments.
The triple talaq bill will serve as an important milestone for India as a uniform civil code is necessary.
