Petition in Supreme Court to stop entry of MPs from Jammu and Kashmir into Parliament
Petition in Supreme Court: A petition has been filed in the Delhi High Court demanding that MPs from the erstwhile state of Jammu and Kashmir be barred from entering Parliament. The petition said that despite the dissolution of the state, MPs are holding their posts illegally. The petition alleged that a total of 10 MPs, including four in the Rajya Sabha and six members in the Lok Sabha from the erstwhile state, are holding their positions in Parliament “illegally”.
The petition claimed that all the MPs including Congress leader Ghulam Nabi Azad and National Conference President Farooq Abdullah are increasing the burden on the government exchequer as they are getting a salary and other allowances along with the post.

This petition has been filed Abdul Ghani Bhat, in which it has been asked to direct the Central Government not to allow all 10 MPs to enter Parliament. Bhat is known for filing RTI and PILs. The petition alleged that the presence of 10 MPs from the erstwhile state in Parliament is “immoral, illegal and unconstitutional”.
It has demanded that they should stop salary, allowances and other facilities to other MPs. Last year, Parliament repealed most of the provisions of Article 370 of the Constitution and reorganized the state into two Union Territories – Ladakh and Jammu Kashmir.

Listing the names of four Rajya Sabha members and six Lok Sabha members, including former Chief Minister Farooq Abdullah, Union Minister Jitendra Singh, and Congress leader Ghulam Nabi Azad, Bhat said their presence in the Indian Parliament is “immoral, illegal and unconstitutional”.
The petitioner claimed that the MPs continued their seats in Parliament “unnecessarily, illegally and immorally” and claimed that they were drawing on the government treasury and enjoying facilities and perks without “authority, logic, and reason”.
The petitioner demanded the court to direct the central government to “politely” prevent their entry inside Parliament.
Bhat further said that the allowances paid to them are destroying the government exchequer, causing harm to the citizens of the country.
“Salaries, allowances and other benefits that have been received after the dissolution of the state on August 5, 2019, can be recovered from them to date,” he demanded. The court is yet to hear this case but the politics is to be followed very soon.
